Heather’s Bouqcakes Terms and Conditions
BY PURCHASING A CAKE / CUPCAKES / CUPCAKE BOUQUET FROM
HEATHERS BOUQCAKES IT IS ASSUMED THAT YOU HAVE READ AND
ACCEPT MY TERMS AND CONDITIONS IN FULL.

All orders by you, the customer, for supply of goods are subject to these terms and
conditions unless varied in writing and signed by both parties. Once an order has been
placed your order is considered firm and there will be a contract between us.  The contract
will end upon satisfactory receipt of goods.

Ordering and Payment
If your order is over £100, a 50% deposit will be required to secure your order. The balance
due will be payable 2 weeks before the event. If I do not receive your deposit, your date will
not be secured.
I accept payment via bank transfer only
Orders may be placed via whatsapp, Messenger (Facebook), Instagram or email

Cancellation/Amendments/postponement policy

You may cancel your order at any time provided the cancellation is made by the person who
made the order or another person authorised to act on their behalf, and is communicated to
me in writing. As this incurs administrative costs, lost business and impacts my commitment
to other customers, I will apply cancellation charges as follows
30 days before due – 100% refund
29-14 days before due – 50% refund
13 days or less – no refund
I may also apply cancellation charges and terminate my services if you fail to pay me on the
due dates given under the payment clause

Following placement of order, should you wish to make any changes, please contact me.  I
will try my best to accommodate changes requested, however, I am unable to accept
changes within the 7-day period before the order is due for collection or delivery. Depending
on the change requested, an additional charge may be applied and shall be payable in
accordance with the terms of the payment clause and the cancellation clause in the event of
cancellation.

If I am prevented from performing my services and delivery by circumstances beyond my
control, including but not limited to strikes, accidents, acts of God, national or local disasters,

damage to premises, weather, infectious diseases, severe illness or similar events, then i will
cancel the order and refund to you the amounts already paid and i will have no further
liability to you.

Collection

Collection times will be offered when you place your order and times should be strictly
adhered to. Any non-collection of orders will result in your order being resold. Any
rescheduled collection times will be solely at my discretion and cannot be guaranteed under
any circumstances

On collection of your order, ensure the product is transported in a cool, air-conditioned
vehicle on a flat surface such as the foot well or anchored in the boot. Do not hold cakes on
your knee and do not put on a seat. I cannot be held responsible for anything that happens
to your cake once you leave the premises. It is solely your responsibility to follow the advice
given and transport your goods carefully

Delivery/Set-up
Prices for delivery and set up fees will be included in your quote
Responsibility for your cakes passes to you once the cake has been collected or delivery
has been accepted. Heathers Bouqcakes accepts no liability for cakes that are damaged
after they have been delivered to the agreed location.

Guidance will be given by myself to the venue to ensure the cake is kept cool and out of
direct sunlight and out of a high traffic area to prevent accidental damage. It is not my
responsibility to ensure the venue adheres to this guidance and therefore I accept no liability
if damage is incurred

Allergies
I offer cakes made with gluten free sponge and can also cater for vegans, however, all my
cakes are baked and decorated in an environment where allergens are present. Unless
specified otherwise, cakes may contain NUTS, MILK, EGGS, WHEAT, SOYA, GLUTEN,
LUPIN, SEASAME SEEDS & SULPHUR DIOXIDE. Food allergy information is available on
request. I cannot be responsible for any incidents involving personal food allergies.

Please note that any colour other than natural buttercream will result in the use of food
colour additives. If you require additional information on this please contact me.

Storage
Due to the perishable nature of my products, I do not recommend keeping longer than 3
days. All my cakes are freshly made without additional preservatives. I advise to store in a
cool dry place in an airtight container. Refrigeration does dry out cake so will reduce the
shelf life of the product. It is your responsibility for the safe storage of your product and to
ensure they are consumed in the recommended time frame.

Designs
All products are handmade and so I cannot guarantee uniformity in colours/designs from
order to order. Batches may vary slightly however I always endeavour to keep consistency
Stacked cakes will be supported by dowels, which should be removed before serving.
Do not push cakes in to faces as dowels may also be included in single tier tall cakes

Hire of cake Stands/separators

Cake stands & separators can be hired from £10+ per item for up to 3 days.

It is the customer’s responsibility to ensure that a suitable sturdy table is provided for the
cake
A security deposit equal to the value of the item hired is also payable. This will be refunded
once the item is returned to me undamaged, in its original condition, within 3 days.
If the item is not returned as agreed or I have to collect it, then the deposit will not be
returned

If the item is returned damaged then the deposit will not be returned
Payment of the deposit will be deemed as acceptance of these terms.

Fresh flowers

Please note that some fresh flowers are not suitable for use as cake decoration as they are
toxic.
If your cake is for a wedding, please discus with your florist to supply these to allow for
continuity.
I can liaise directly with your florist regarding floral decorations required for your cake during
the weeks before your wedding so please ensure you have ordered these beforehand. I can
meet your florist at the venue or they can be left on the cake table however, please note I
cannot accept responsibility for flowers left this way.

Please obtain all fresh flowers from a florist and liaise with them for details and advice on the
toxicity of flowers as I cannot be held liable for any contamination to your cake that may
arise from their use/misuse

Complaints
It is assumed that once you accept the cake either at collection or via delivery, you are
happy with the product. In the unlikely event that you have a complaint about your cake,
please inform me immediately so that I have the opportunity to resolve matters. If any
problem cannot be resolved at that time, then you should write to me within 7 days to enable
me to investigate and report to you. Accordingly it is a term of our agreement with you that I
cannot entertain complaints made after 7 days as I am deprived of the opportunity to
investigate any facts that you may complain of. If I cannot resolve your complaint following
your writing to me, you will agree to meet with me to try to resolve matters. If this meeting
fails to resolve any dispute, any legal claim you bring will be limited in value to the total cost
of the cake and in respect of which any complaint is made.

Copyright & Data protection

Copyright & ownership of all cake designs by Heather Southern remains with Heather’s
Bouqcakes and I reserve the right to use photos of my cakes for advertising purposes
including but not limited to, on my website, Social media platforms and in any other
advertising material.

I do not pass on your personal details to any 3 rd parties. I will keep your details on file until
you have paid in full and any hired items have been returned. Once your order has been
collected/delivered, and financial details are destroyed.
